These Terms of Service ("Terms") govern all contracts between Mustafa Serhat Dündar, Bergstraße 70, 10115 Berlin, Germany ("we," "us," "our") and you regarding the use of the website https://www.latencytest.me, the latency test, the dashboard, uptime monitoring and alerts, shareable reports, the REST API and the MCP server (collectively, the "Services"). We operate latencytest.me as a sole proprietor (Einzelunternehmer) under our own name.
A "consumer" is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 German Civil Code, BGB). A "business customer" is any natural or legal person or partnership with legal capacity acting in the exercise of their trade, business or profession (§ 14 BGB). Provisions that apply only to consumers or only to business customers are marked as such.
Deviating, conflicting or supplementary terms of business customers do not become part of the contract unless we expressly agree to them in text form. Individually negotiated agreements take precedence over these Terms.
The contract language is English. We are not subject to any specific codes of conduct.
latencytest.me measures the latency of HTTP requests to websites and APIs, broken down into DNS lookup, TCP connection, TLS handshake, server processing (time to first byte) and content transfer.
The features, limits (for example, the number of monitored endpoints and the data retention period) and prices of each plan are those shown on our pricing section at the time of your order and form part of the contract.
The presentation of our plans on the website does not constitute a binding offer, but an invitation for you to place an order.
Free account: A contract for the free account is concluded when you complete the sign-up process and your account is created. Using the free latency test without an account does not create a contract with ongoing obligations; Sections 5, 6 and 18 apply accordingly.
Paid plans: The order process works as follows:
We store the contract text. After conclusion of the contract, we send you the order details, a link to these Terms and the withdrawal policy by email. The current version of these Terms is always available at https://www.latencytest.me/terms, and invoices are available through the billing portal linked in your dashboard.
You must provide accurate information when registering and keep it up to date. If you register on behalf of an organization, you confirm that you are authorized to bind it to these Terms. You may sign up using a third-party login; in that case, we receive basic profile information from that provider as described in our Privacy Policy.
You must keep your login credentials and API tokens confidential and may share API tokens only with persons and systems within your own organization. Please notify us without undue delay if you suspect that a token has been misused, and revoke it in your dashboard. You are responsible for usage through your account and API tokens unless you are not at fault for the misuse.
Our servers send real HTTP requests to the URLs you enter or configure. You are therefore responsible for making sure that you may send these requests. In particular, you may only test or monitor endpoints that you own or operate, or that you are otherwise authorized to test, and only in a way that complies with the terms of use of the respective website or API.
You may not:
You decide which request headers and request bodies are sent. If you add credentials (for example, API keys or authorization headers) to a monitored request, we store and use them only to perform the requests you configured. We recommend using dedicated, read-only credentials with minimal permissions for monitoring.
Measurements are taken from our servers in Germany and reflect the network path, conditions and time of each request. Results can differ from what your users experience in other locations or networks, and individual results can be affected by temporary network events outside our control. Measurements are technical indicators, not a certification of compliance with a service level agreement.
Alerts are delivered through third-party channels that you choose (email, Slack, PagerDuty or Opsgenie). Their delivery depends on those services and on the correctness of the destination you configured, and can be delayed. We recommend that you do not rely on latencytest.me as your only means of detecting outages of business-critical systems.
This section describes the nature of the Services; it does not limit your statutory rights under Section 17 or our liability under Section 18.
"Your content" means the URLs, request settings, headers, request bodies, alert configurations and other data you enter, as well as the measurement results we create for you. You remain the owner of your content. You grant us the right to store, process and transmit your content to the extent necessary to provide the Services to you.
When you generate a report, we create a link with a long, randomly generated token. Anyone who has this link can view the report, including the monitored URL and its measurement results, without logging in. You decide whether and with whom you share report links.
For the term of the contract, we grant you a non-exclusive, non-transferable, non-sublicensable right to use the Services within the limits of your plan. All rights in the Services, our software, documentation, website content and the latencytest.me name and logo remain with us. You may use measurement results and reports for your own internal and external purposes, including sharing them with your customers.
All prices are stated in US dollars (USD) and are final prices. In accordance with § 19 of the German VAT Act (UStG, small business regulation), no VAT is charged. Business customers are responsible for any taxes payable in their own country.
Payments are processed by Stripe. The available payment methods are shown at checkout. The yearly plan is payable in advance at the beginning of each billing year; the lifetime plan is a one-time payment. Any currency conversion fees charged by your bank or card issuer are not charged by us. Invoices are provided electronically.
If a payment fails, we will notify you by email. If the payment is still not made within a reasonable period after this notice, we may suspend access to paid features in accordance with Section 20.
The yearly plan includes a 7-day free trial, as shown on our website and at checkout. A payment method is required to start the trial.
Unless you cancel before the trial ends, the trial converts into a paid yearly subscription at the price shown at checkout, and your payment method is charged at the end of the trial. If you cancel during the trial in one of the ways described in Section 11, you will not be charged. Your statutory right of withdrawal as a consumer (Section 13) remains unaffected.
Free account: The contract runs for an indefinite period. You can terminate it at any time by deleting your account or by notifying us. We can terminate it in accordance with Section 20.
Yearly plan: The subscription has an initial term of one year, starting at the end of the free trial.
You can cancel your subscription:
When a paid subscription ends, access to Pro features ends and your account continues as a free account. The right of both parties to terminate for good cause (§ 314 BGB) remains unaffected.
The lifetime plan is a one-time payment that gives you access to the Pro plan for as long as we operate latencytest.me. It is not a subscription and does not renew. It is personal to your account and cannot be transferred to another account.
The scope of the Pro plan can change in accordance with Section 14. We may discontinue latencytest.me as a whole with at least 90 days' notice by email. If we discontinue it, or end your lifetime plan for a reason for which you are not responsible, within 36 months of your purchase, we refund 1/36 of the price you paid for each full month remaining until the end of those 36 months.
You can end your lifetime plan at any time by deleting your account or by notifying us; this does not entitle you to a refund beyond your statutory rights. The right of both parties to terminate for good cause (§ 314 BGB) remains unaffected.
This section applies only to consumers. Business customers do not have a statutory right of withdrawal.
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day of the conclusion of the contract.
To exercise the right of withdrawal, you must inform us (Mustafa Serhat Dündar, Bergstraße 70, 10115 Berlin, Germany, email: [email protected]) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
End of withdrawal policy.
(Complete and return this form only if you wish to withdraw from the contract.)

We may change the Services if there is a valid reason, in particular to comply with new legal requirements, to fix security issues, to respond to changes in third-party services we integrate with (such as alert channels), or for technical development and improvement of the Services. Such changes are made at no additional cost to you, and we inform you about them in a clear and understandable way.
We announce changes that require you to adapt your integration (for example, removing API endpoints or fields, or an alert channel) at least 30 days in advance by email, unless an earlier change is necessary for legal or urgent security reasons.
If a change impairs your access to or use of the Services more than insignificantly, you may terminate the affected paid plan free of charge within 30 days of receiving our notice or of the change taking effect, whichever is later. We refund any fees paid in advance for the period after termination on a pro-rata basis; for the lifetime plan, the refund rule in Section 12 applies. For consumers, this right does not apply if we enable you to keep the unchanged Services at no additional cost (§ 327r BGB).
The price of your yearly subscription is fixed for the current billing year. We will not increase the price of an existing subscription without your express consent, which we will ask for at least 30 days before the proposed change. If you do not consent, your subscription continues at the existing price; in that case, we may terminate it in accordance with Section 20. Price reductions apply without your consent. Lifetime plans are not subject to price changes.
We aim to keep the Services highly available, but we do not guarantee a specific level of availability unless agreed separately. Monitoring checks may not run during maintenance or disruptions. We announce scheduled maintenance in advance where possible and carry it out at times of low usage where possible.
We provide support by email on a best-effort basis. Binding response times apply only if agreed individually.
For consumers, our statutory obligation to provide the Services in conformity with the contract, including any necessary updates, remains unaffected by this section.
The statutory warranty rights apply. For consumers, these are in particular the rules on digital products (§§ 327 et seq. BGB).
For business customers, liability for damages is subject to Section 18, and strict liability for defects already existing when the contract is concluded (§ 536a (1), first alternative, BGB) is excluded.
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under a guarantee we have given, in the case of fraudulent concealment of a defect, under the German Product Liability Act (Produkthaftungsgesetz), and wherever liability is mandatory by law.
In cases of slight negligence, we are liable only for breaches of essential contractual obligations, i.e. obligations whose fulfillment is essential for the proper performance of the contract and on whose observance you may regularly rely (Kardinalpflichten). In such cases, our liability is limited to the foreseeable damage typical for this type of contract.
Otherwise, our liability for slight negligence is excluded. The above limitations also apply in favor of our legal representatives and vicarious agents.
For the free latency test and the free account, which we provide free of charge, we are liable only for intent and gross negligence (§§ 521, 599 BGB applied by analogy), except in the cases of unlimited liability listed in the first paragraph.
This section applies only to business customers. You indemnify us against claims by third parties arising from your culpable breach of these Terms or of applicable law in connection with your use of the Services, in particular from requests to endpoints you were not authorized to test or monitor (Section 5), including the reasonable costs of our legal defense at statutory rates. We will inform you of any such claim without undue delay and give you the opportunity to defend against it.
We may temporarily pause monitored endpoints or block access, API tokens or report links if your use endangers the security or stability of the Services, if we receive a credible complaint that you are sending requests to an endpoint without authorization, if you seriously breach Section 5, or if a payment is overdue despite a reminder. We will limit any block to what is necessary, inform you without undue delay, and lift it once the reason no longer exists.
We may terminate the free account with 30 days' notice. We may terminate yearly subscriptions with 30 days' notice, effective at the end of the current term at the earliest. Lifetime plans end only in accordance with Section 12. Our right to terminate for good cause (§ 314 BGB) remains unaffected; as a rule, we will first give you a warning and a reasonable opportunity to remedy the breach.
If we terminate a paid plan for a reason for which you are not responsible, we refund any fees paid in advance for the period after termination on a pro-rata basis; for the lifetime plan, the refund rule in Section 12 applies.
We process personal data in accordance with the GDPR and the German Federal Data Protection Act (BDSG). Details, including the service providers we use, any transfers to countries outside the European Union and the applicable safeguards, are described in our Privacy Policy.
The Services are not designed to process personal data in monitored requests, and you should not include personal data in URLs, headers or request bodies you configure. If your use nevertheless requires a data processing agreement under Art. 28 GDPR, please contact us.
If you connect an alert channel (Slack, PagerDuty or Opsgenie), we send alert messages to the destination you configured. Your use of these services is governed by your own agreement with their providers; we are not responsible for their availability or for how they process the alerts.
The Services may contain links to third-party websites. We have no influence on their content or data processing and are not responsible for them. If we become aware of unlawful content on a linked website, we will remove the link without undue delay.
You are not obliged to give us feedback. If you send us feedback or suggestions, we may use them to improve the Services without compensation to you.
We send contract-related notices to the email address stored in your account. You can send declarations to us (including cancellations) by email. We do not require any stricter form than text form.
The version of these Terms in force at the time of your order applies to your contract. We will change these Terms for existing contracts only with your express consent; purely editorial changes that do not affect the content may be made at any time. Changes to the Services and to prices are governed exclusively by Sections 14 and 15.
These Terms and all contracts under them are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country of your habitual residence.
If you are a merchant (Kaufmann), a legal entity under public law or a special fund under public law, or if you have no general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from these contracts is Berlin, Germany. For consumers, the statutory places of jurisdiction apply.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 German Consumer Dispute Resolution Act, VSBG).
If any provision of these Terms is or becomes invalid, the validity of the remaining provisions remains unaffected, and the statutory provisions apply in place of the invalid provision (§ 306 BGB).
You may transfer rights and obligations under the contract to third parties only with our consent; § 354a German Commercial Code (HGB) remains unaffected.
You can reach us by email at [email protected] or by post at Bergstraße 70, 10115 Berlin, Germany. Our full legal notice is available in the Impressum.
